Red Kite Lending Limited whose registered office is at Ty Menter Navigation Park, Abercynon, Mountain Ash, Wales, CF45 4SN, United Kingdom is a limited company registered in England under the company registration No.14088376 (“the company”). The company is unregulated.
Personal data is collected, processed and stored by “the company”. When we do so we are regulated under the UK General Data Protection Regulation (UK GDPR). We are responsible as a “controller” of that personal information for the purposes of those laws.

This website is owned by Red Kite Lending Limited and managed by Red Kite Lending Limited.
We respect your privacy and value your trust. Access to this website is anonymous as Red Kite Lending Limited does not in any way specifically identify those who visit our site. The site and its content are held on a remote server.
We do not collect personal information such as names, addresses, email addresses, telephone numbers etc from our website unless you choose to subscribe to our marketing email list, or submit this information yourself via the contact form.
If you were to email Red Kite Lending Limited using the email links featured on any of our pages of the site, this will reach us via a secure connection (SSL Certificate) but please consider the contents of your email as in general please avoid any highly sensitive personal or financial information. These emails will only be used to address the query posed by them – we will not use your information for any other purpose. Your email address will not be sold on to any other party or used for any other commercial purpose whatsoever. No disclosure of the contents of your email will be made to any other party without your explicit consent.

This policy explains when and why we collect personal information about you; how we use it, when we share your data with others and how we keep it safe.
This policy is intended for clients and prospective clients. We ask that you read this privacy policy carefully alongside our Customer Form/Terms of Business as it contains important information on how and why we collect, sort, use and share personal information, your rights in relation to your personal information and who to contact in the event you have a complaint.
The Personal Data we collect and use
The information we request from you and process will be dependent of the loan request from you. In many cases personal data will be restricted to basic information, such as name, address, contact details and property information needed to complete our loan assessment and ID Requirements. Some of the work we do may require us to ask for more sensitive information. We will also obtain your bank details where we may need to send monies to you from our client account. We will only hold and use your personal information which is relevant and necessary to complete our business with you.
How we get the personal information and why we have it
Most of the personal information we process is provided to us directly by you for one of the following reasons:
- A request for a new loan.
- An enquiry on an existing loan.
We also receive personal information indirectly, from the following sources in the following scenarios:
- Broker or Intermediaries.
- Third party introducers.
Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are:
- Your consent. You are able to remove your consent at any time. You can do this by contacting us.
- We have a contractual obligation.
- We have a legal obligation.
- We have a vital interest.
- We need it to perform a public task.
- We have a legitimate interest.
Where your personal information is necessary for us to fulfil our contractual or legal obligations, if you fail to provide certain information when requested, we may not be able to provide you with a loan or to perform the terms of any contract we have entered into with you.
Why we need your personal data
The primary reason for collecting and processing your personal data is to allow us to carry out our business with you – which will ordinarily be to lend money to you for property related transactions. Our lawful basis for holding your personal data can be found in Article 6(1)(b) of the UK GDPR.
We may also legally hold your data if you have explicitly consented us to hold your information (pursuant 2 to Article 6(1)(a) UK GDPR); to allow compliance with our legal obligations (pursuant to Article 6(1)(c) UK GDPR); or to protect your vital interests (pursuant to Article 6(1)(d) UK GDPR).
There may be some personal data that require your specific consent. If this is the case, we will contact you separately to ask for your consent, which you are free to withdraw at any time. If you withdraw your consent we will cease to process your information on that basis, however this will not affect our legitimate processing activities undertaken prior to that point, during any period when your consent was valid.

How we will use your personal data
We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and explain the legal basis, which allows us to do so.

- Verifying source of funds
- Communicating with you
- Keeping records of your loan
- To enable to work with our third party service providers
- Seeking services from third parties, such as other professionals and government bodies
We do not use any automated decision making or profiling.
Who has access to your personal data
We have procedures in place to ensure the secure processing of your personal data. Generally, we will only use your information within Red Kite Lending Limited or Red Kite Bridging Limited. However, in carrying out your loan application we may need to disclose your information to others, including but not limited to other professionals acting on your behalf, other solicitors, property and or business professionals and government bodies.
Where your information is shared with external parties, we ensure that they comply, strictly and confidentially, with our instructions and they do not use your personal information for their own purposes unless you have explicitly consented to them doing so.
We do not transfer your personal data outside the UK.
Protecting your data
We recognise that your information is valuable, and we take all reasonable measures to protect it.
We have technology to protect personal data from loss, misuse, alteration or destruction and ensure that, where possible, physical access to our buildings is carefully controlled. We also insist that consultants and staff agree to protect confidentiality of all information.
Retaining your data
Your personal information will be retained, usually in computer or paper files, only for as long as necessary to fulfil the purposes for which the information was collected; or as required by law; or as long as is set out in any relevant contract/agreement you may hold with us. We will then keep your information for an additional period as set out below.
As a guide we will keep your information for a minimum of 6 years from the closure of your loan, in case you, or we, need to revisit the details held on file to discuss the loan, or the management of the loan with you. This will apply even if you do not proceed with your loan to a conclusion. However, certain types of matters may be kept for longer periods and some, such as those involving wills or trusts, may be kept indefinitely.

Your rights
- Your right of access – You are entitled to request a copy of your personal data (otherwise known as a Subject Access Request). If you wish to make a request, please do so in writing using the contact details set out on the final page of this privacy policy. A request for access to your personal data means you are entitled to a copy of the data we hold on you. If the information we hold about you is wrong or misleading, you can ask us to change it.
Under data protection law, further rights include:
- Your right to rectification – You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
- Your right to erasure – You have the right to ask us to erase your personal information in certain circumstances.
- Your right to restriction of processing – You have the right to ask us to restrict the processing of your personal information in certain circumstances.
- Your right to object to processing – You have the right to object to the processing of your personal information in certain circumstances.
- Your right to data portability – You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.
You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you. On occasion, it may take us longer to respond if your request is particularly complex or you have made numerous requests. If this is the case, we will notify you and keep you updated.

CRA checks on individuals (for AML or credit checking purposes)
We will perform credit and identity checks on you with one or more Credit Reference Agencies (CRAs). To do this, we will supply your personal information to CRAs and they will give us information about you. This will include information from your credit application and about your financial situation and history. CRAs will supply to us both public (including the electoral register) and shared credit, financial situation and financial history information and fraud prevention information. We will continue to exchange information with you about CRAs while you have a loan account with us, and we will inform CRAs about your settled accounts. If you borrow from us and do not repay in full and on time, CRAs will record the outstanding debt. This information may be supplied to other organisations by CRAs. When CRAs receive a search from us they will place a search footprint on your credit file that may be seen by other lenders. Your right to complain

If you are not happy with our response or believe we are not processing your personal data in accordance with the law, you can complain to the Information Commissioner’s Office (ICO).
